DSober is a designated-driver coordination app operated by Kappa Theta Pie ("we," "us"). It helps members of our chapter request rides, volunteer as designated drivers, and complete a brief sobriety check before driving. By creating an account or using DSober, you agree to these Terms. If you do not agree, do not use the app.
Who Can Use DSober
DSober is for members of our organization. You must be of legal age, have an active account in good standing with your chapter, and provide accurate information. Because the app is used in contexts involving alcohol, you must follow all applicable laws, including those regarding alcohol and driving.
What DSober Does
DSober helps members find a sober driver, lets members volunteer to drive, and runs a short sobriety check (SEP) before a driving session. We make the platform available; the actual rides, driving, and decisions about whether it is safe to drive are made by members, not by us. We do not provide transportation and do not employ or supervise drivers.
Your Account
- Keep your login credentials private; you are responsible for activity on your account.
- Provide accurate profile, vehicle, and license information and keep it current.
- Notify us if you believe your account has been compromised.
If You Volunteer to Drive
- You must hold a valid driver's license, carry the insurance required by law, and drive a vehicle that is legal and safe to operate.
- You must be sober and fit to drive, complete the sobriety check honestly, and stop driving if your driving status is revoked.
- You are solely responsible for operating your vehicle safely and lawfully and for everyone you transport.
If You Request a Ride
- Treat drivers and other members with respect and follow reasonable safety instructions.
- You are responsible for your own conduct and belongings during a ride.
- Never pressure anyone to drive who is unfit, and never rely on the app alone to decide that a driver is safe.
The Sobriety Check (SEP)
The sobriety check is a screening aid that compares a short reaction-time result, voice sample, and selfie against a baseline. It is not a medical or legal determination of sobriety and is not a guarantee that a person is fit to drive. Passing the check does not relieve anyone of the responsibility to use good judgment, and you should never drive, or get in a car, if you have any doubt about safety.
Acceptable Use
You agree not to:
- Falsify a sobriety check, impersonate another member, or misrepresent your eligibility or driving status.
- Use DSober for any unlawful purpose, or to harass, endanger, or harm others.
- Interfere with, disrupt, or attempt to gain unauthorized access to the app, its systems, or other members' data.
We may suspend or remove accounts that violate these Terms or put others at risk.
Disclaimers & Assumption of Risk
DSober is provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the app will be uninterrupted, error-free, or that any driver, ride, or sobriety check will meet your expectations. Coordinating and accepting rides is voluntary, and you assume the risks associated with traveling with a designated driver who is a fellow member.
Limitation of Liability
To the fullest extent permitted by law, Kappa Theta Pie and its members, officers, and volunteers will not be liable for any indirect, incidental, or consequential damages, or for any injury, loss, or damage arising from rides, driving, the conduct of any member, or your use of (or inability to use) the app. Nothing in these Terms limits liability that cannot be limited under applicable law.
Termination
You may stop using DSober and permanently delete your account at any time from Profile → Delete My Account. We may suspend or terminate access if you violate these Terms or to protect the safety of members. Provisions that by their nature should survive termination will continue to apply.
Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above; continued use of DSober after a change means you accept the updated Terms.
Governing Law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules.
